PFT: Peyton's arm strength remains a question

600_128637045Getty Images

For an athlete caught using steroids, the four-game suspension is nothing compared to the scarlet ?S? that gets applied to their permanent P.R. record.

The player never will be viewed the same way. ?If he succeeds, cynics will say it?s because he?s using steroids. ?If he becomes average or worse, the fact that he?s not using steroids any longer will be identified as the reason.

But since the league says nothing publicly about the reason for a suspension imposed under the NFL policy regarding anabolic steroids and related substances, the player who is suspended can say whatever he wants ? and the league never will correct the record.

Previously, players popped for steroids blamed a spiked over-the-counter supplement. ?Even if anyone ever bought that excuse, no one does anymore.

And so it could be that the new non-steroid alibi arises from Adderall, a prescription ADD medication.

Giants safety Tyler Sash blames his four-game suspension on Adderall. ?Previously, Packers defensive end Mike Neal did the same thing. ?Both claim they were using it with a prescription.

If they?re telling the truth (and we?re not saying they aren?t), why didn?t the NFL reduce or eliminate their suspensions?

Giants running back Andre Brown was using Adderall with a prescription but without advance approval from the league. ?He tested positive, he appealed, and his suspension was lifted. ?Ditto for Texans punter Brett Hartmann, whose four-game suspension was cut to three ? and who now has approval to take Adderall.

If Neal and Sash are telling the truth, the NFL?s procedures seem to be horribly inconsistent. ?(Then again, even if Neal and Sash aren?t telling the truth, the fact that Brown got no suspension and Hartmann received three games makes no sense.)

Either way, Adderall provides players with a convenient strategy for avoiding the stigma of steroids. ?The fact that league can say nothing about the facts and circumstances surrounding the suspension allows the players to say whatever they want.

Open Adoption -- Beautiful and Painful-- Is the Best Solution We Can Offer Our Girl

Wow, a birth family visit is a lot to process.? And if it feels like a lot to me, I can only imagine how it feels to an 8-year-old.

Katie and I spent the weekend with her birth mom and her birth siblings.? We met in the city of St. Louis, MO (not where they actually live), and we spent virtually every waking moment together.

We arrived on a Friday afternoon, and M and her kids met us at our hotel.? M?s kids were scheduled for exactly one vacation this entire summer:? our visit.? And we made the most of it.? Katie instantly took on the role of little sister.? E, her big sister, is 16, and D, her big brother, is 13.? For Katie, being the youngest was an extreme role reversal.

At home, Katie is the oldest and biggest by a large margin.? Her two little sisters are tiny little peanuts, and Katie is the much sought-after tween.? ?We give Katie a good amount of responsibility, and we place the types of expectations on her that always fall on the shoulders of oldest children.

It was with no small amount of wonder that I watched Katie transform into the baby of her birth family.? Within five minutes, she even looked smaller to me (and she was, by comparison!).? She was suddenly the youngest, the coddled little one, and it made me smile.? Everyone deserves a chance to be the baby at some point, but very few oldest kids ever get to try the role on.

Chalk one up for open adoption.? It gave Katie a chance to be a different version of herself.? For once, everyone catered to Katie?s wishes.? There was no baby sister crying that cut short a trip to Maggianos for dinner.? There was no younger sister complaining that she was bored when we went to the Museum of Westward Expansion (although Annie Rose would have actually loved that, because it included a section on our 16th President).

It was Katie?s party, and she was the star.? Those were the exact words her birth mom used as she laughed with me.? ?Honey, we are here for one reason, and that is to be with you.? It's your show,? M told Katie.? And so the kids spent a lot of time swimming in our hotel pool, which is Katie?s idea of a perfect day.? E and D took turns throwing Katie in the air, and she screamed with glee as she landed in the water.

Those were the good parts.? The hard part was the absolute confirmation of how difficult her birth family?s life is.? For the first time, Katie was old enough to pick up on conversations and to observe realities.

Here is what her birth family does NOT have:

Access to services.? They live in a tiny town, and there are simply not many services available to the kids.? No summer camps.? No community pool.? No organized, fun subsidized activities for the kids to do during the day.? ?We do nothing,? E and D answered, when asked what they do during the summer.? They do not have healthy food.? It is too expensive to buy fresh fruits and vegetables and proteins, when a box of pasta will fill you up at one fifth the cost.

No computer.? M sold it last year when they could no longer pay their mortgage and they lost their house.? No health insurance, which means they elect to seek no medical attention for conditions that we treat without hesitation.? No adult at home during the day, because M is a single working mom.? D was terribly disappointed that my husband Andrew had not come on the trip, because he is desperate for a father figure.

Here is what they DO have:

Resilience.? Spirit.? Love and affection for each other.? Generosity.? A sense of humor.? Morals and values.? E told me that she LOVES the library because she loves to read and read and read.? E also loves to sing, and she performed some Adele for us, much to Katie?s and my delight.? D loves to fix things.? He tinkers with stereos and engines.? He wants to be loved.? He wants someone to cuddle with.? He was like a big teddy bear with Katie, wrapping his arms around her and hugging her with all his might.

We sat eating lunch on Saturday, and I asked the kids, ?What do you think the greatest invention is??? E said the phone, and D said the motor.? Then it was Katie?s turn.? She thought for a minute and responded, ?Love and family.?? M and I shared a look of utter adoration for our girl.

On Saturday night, we ordered in some Papa John?s pizza (Katie?s favorite), and we all climbed into my giant king-size hotel bed, and we watched movies on the Disney channel.? Monsters, Inc followed by Mulan.? The kids and M also played Candyland.? I hung back, wanting to give them time as a group of four.? I curled up in the corner of the bed and read a book, watching as Katie and her other family spent a perfectly normal evening together.? And yet it was anything but normal, of course, because Katie is my child and theirs too.

After everyone left, Katie laid in bed next to me, and she asked me, ?Why can?t they come live with us and have good food and books and things??? Such a hard question to answer.? ?We have room for the family we are,? I tried to explain, ?and even if we tried to make it work, it would never be as simple as it is this weekend, when we are together for the sole purpose of having fun.?

Katie accepted that and went to sleep.? She behaved like an angel during the visit, but as expected, when we returned home yesterday, the fallout began immediately.? Crying, fighting, anger, whining.? I completely expect it.? In fact, I would worry if she didn?t show that she is processing all this.

Still, it isn?t fun!? We are using 123 Magic to help with the behavior, and I am trying to be extra supportive emotionally.? Katie had a big meltdown this morning before camp (part of this is due to fatigue because she was up late both nights of the weekend).? Her camp called me several times this morning to say that Katie wanted to come home because her head was hurting.? I picked her up (she was fine, as I suspected, and merely needed some extra TLC).

And so it goes.

The integrating of lives.? The complexities of missing her birth family yet loving her adoptive family.? The inklings of survivor?s guilt stirring in her consciousness.? The fears of abandonment and foster care and forever families changing their mind.? This open adoption ? a phenomenon both beautiful and agonizing?that has emerged as the very best our two families have to offer our little girl.

Engine Remapping ? What Ever It Is

What do you know about engine remapping? You can be forgiven for being ignorant about engine remapping if you aren?t really into your cars. If you work in automobile mechanics or have even a passing interest in increasing performance of your vehicles, engine remapping should be something you know about and are deeply invested in. Little do the general public know that their car holds more power than they may originally think, and with engine remapping they can unlock that potential. It may be just a little more acceleration, just a little more power, but drivers can appreciate that little bit of an extra kick when they?re trying to overtake on a busy motorway, or just want to catch the light before it turns red. A lot of people see engine remapping as retuning, and in a way they might be right. For the most part engine remapping is simply about letting your car work to its maximum potential. Quite a lot of engines are locked down for entirely selfish reasons from automobile manufacturers; they don?t want you to know that your little domestic car can get as good performance as sports models or retuned editions. They want to keep you in the dark in regards to engine remapping and the benefits engine remapping can hold for you and your car, all to try turning a little extra profit out of exploiting you.

One of the big myths about Engine Remapping is that is utterly destroys your fuel economy. This is wrong, outright wrong. Those in the know will be able to tell you that engine remapping improves performance much more than it affects fuel economy, so you don?t need to worry about bankrupting yourself for fuel just because you had engine remapping done to your car. If more people knew about engine remapping the road would indeed be a more interesting place, especially for older cars. People are just unaware of the potential of their vehicle unfortunately, and as a result engine remapping is kept under wraps until people do their research. Hopefully now you know about engine remapping and may consider it yourself.

Life in the Slow Lane: Potato Salad and Ernest Hemingway

My reading one year whilst on holiday was 'Islands in the Stream' - by Ernest Hemingway.? I really can't remember anything about the storyline - I just remember I enjoyed reading it at the time?and the thing that stuck out most for me in the book?was Hemingways' descriptions of food.? In particular Potato Salad - and now, whenever I make it - it takes me right back to that book and that holiday. "I'll pass you up the rifle and get the hell back to those potatoes.? The boys like potato salad, don't they?? The way we fix it?"
"Sure.? Roger too.? Put in plenty of hard-boiled egg and onion."
"I'll keep the potatoes good and firm.? Here's the rifle."? (Islands in the Stream)

Hemingway used to say that he preferred writing when he was hungry because it was good discipline.? Whatever it was, I expect that it made his descriptions of food and drink more potent.

Certainly these are scattered throughout 'Islands in the Stream' and if you can read a book without craving a fresh onion sandwich or a cold gin-and-tonic, then you probably have a healthy immunity to your appetite.

There is something about salty sea air, warm sun and bracing surf that somehow makes lunch seem incomplete without potato salad.? Part of Hemingways' genius was in making such connections for those who read his stories.
There are many different ways of preparing Potato Salad - but the one that suits my taste which has been perfected over the years is - the simpler the better.? Potatoes, Spring Onions, Hard Boiled Eggs and chopped Chives mixed together with Mayo?and a little Salad Cream and sprinkled with Paprika.

The French add olive oil, mustard and shallots with thyme - the Spanish add vegetables, olive and sherry vinegar.

The secret is to chill it for a couple of hours before eating to let all the flavours meld together.

"Boys seem to be doing all right" Eddy said.? "We've got fish for dinner already."
"Sounds fine.? How's that potato salad?"
"It isn't cold yet Tom."
"Eddy you like to cook don't you."
"Damn right I like to cook.? I like going in a boat and I like to cook.? What I don't like is rows and fights and trouble." (Islands in the Stream)

So there you have it - whenever I make potato salad I think of Ernest Hemingway - funny how the mind works isn't it?

(The first part of the book takes place in Bimini in the Bahamas - take a look at the video and see how fabulous it is)

7 die in head-on collision on I-10 near Phoenix

PHOENIX (AP) ? Seven people have died in a crash on Interstate 10 near Phoenix after a semitrailer truck crossed the highway's median and struck a van head on.

Carrick Cook, a spokesman for the Arizona Department of Public Safety, says the victims were all inside the van when the crash happened Sunday about 60 miles west of Phoenix.

Cook says the driver of the semitrailer truck and his wife were taken to a hospital.

Cook says the vehicles caught fire after the force of the crash pushed them into a culvert.

At least seven people were in the van. The identities and hometowns of those who died in the crash weren't immediately released.

Cook says the van was registered to someone from western Arizona.

wasps nest removal Islington, pest cont - Wasp ... - IdeaMarketers.com

Living in Islington is like living in two worlds at once. You see the spanning Islington Streets and are constantly reminded of modern luxury while the Highbury Fields get you to commune with nature. It is a desirable residential district, but with one fault especially during summer-- wasp. Wasps have the tendency to build nests on the roofs of homes. And to avoid the painful stings of wasps, learning how to remove wasps at home is of utmost importance, most especially if you have kids.

Home Remedies for Wasp Nests

First, it is important to make sure first that the wasps don't enter your home with proper home sealing. You can also use wasp traps, which are available in stores. Another commonly used technique to remove wasps is the use of mix fruit juice and meat in a jar. The sweet smell of the fruit juice plus the stench of the decaying meat attract wasps. Once they follow the scent and enter the jar, they will get drowned in the juice.

However, these techniques alone are not enough as they will not completely eliminate the problem. If their nest is not completely destroyed, they will continue to multiply in number. Moreover, if you try to remove them without proper equipment and garment, you can suffer from serious sting or bites. One thing that you should keep in mind when dealing with these pests is that they can attack you aggressively, most especially if you try to destroy their nest. To avoid these, you can benefit from using the help of a pest control Islington contractor.

What a Wasp Nest Removal Islington Contractor Can Do?

Having a safe home free from wasps not only entails sealing all possible entries of wasps to your house. To completely solve the problem, their breeding place or nest should be destroyed properly and removed through efficient and safe techniques.

A good wasp nest removal contractor performs not only effective but also safe wasp nest removal techniques. Depending on the type of wasp present as well as the magnitude of the situation, wasp removal usually entails destroying the nest through chemical sprays. These sprays work by paralyzing the insects for a safe manual extraction. Sprays that contain pyrethoids work well for this purpose without causing any harm to the environment.

Another wasp nest removal technique is the use of the Ficam D - a dust type insecticide. This process usually takes a few hours to a day, until all wasps are killed and no foraging wasps return.

If you are in Islington and are experiencing wasps related problems, you would benefit from using the help of a wasp nest removal Islington contractor to avoid serious injuries that these pests can cause. This is a must most especially if you do not know how these pests behave.

If you are worrying about wasps nests in your home, why not let a good pest control Islington do the job for you. Contact us to learn more about our wasps nest removal services.

How Queen was persuaded to join Olympics Opening Ceremony act

LONDON ? The queen of England was persuaded to take part in her hilarious Opening Ceremony act with James Bond following a personal plea from her favorite movie director.

The English monarch made an exception to her public policy of speaking only in formal settings in order to perform a scene with Bond actor Daniel Craig that ended with stunt doubles resembling the pair leaping from a helicopter above the Olympic Stadium.

[ Related: Queen causes stir in athletes' village ]

The segment stole the show Friday night and was made possible after Danny Boyle, the brains behind the ceremony and an award-winning director, used the queen's love of his greatest film ? "Slumdog Millionaire" ? to his advantage.

"The queen made herself more accessible than ever before," Boyle said.

Yet her majesty may not have agreed to the highly unconventional request if it had not come from Boyle himself. It is not known whether Boyle realized this or not, but the entire royal family is huge fans of his work and have watched "Slumdog Millionaire" on countless occasions.

Princes William and Harry, the queen's grandsons, joined the "Slumdog" craze in 2008, when the film broke box-office records and walked away with eight Academy Awards.

[ Photos: London Games Opening Ceremony ]

William's wife, Kate, is also an admirer, as is his father, Prince Charles, and Charles's wife, Camilla, as well as cousin Zara Phillips, who is competing in the Olympic equestrian events. The queen watched the movie on the advice of her grandchildren and made no secret of her enjoyment of the production, which followed the journey of an orphaned Indian boy from the slums of Mumbai.

"It is very much a favorite," a royal source said. "The queen watched it after being encouraged by William, Harry, and others and liked it so much she saw it again. That certainly didn't hurt when Mr. Boyle made his request for her royal highness to be involved in the Games in an extra role beyond her official capacity."

The Bond story reflected what has been a noticeable softening in the public persona of the queen in recent years. The image of the royal family was at a significant low point following the death of Diana, princess of Wales, and the queen has since tried to convey a more down-to-earth personality.

[ Related: NBC blasted for not showing Opening Ceremony live ]

The royal video saw Bond driven into the grounds of Buckingham Palace in the back of a black London taxicab before being led to meet the queen, who was writing at a desk. She turned to face him and uttered the single line: "Good evening, Mr. Bond."

Agent 007 and the monarch then climbed aboard a Westland helicopter, which took off into the London skies, then "reappeared" at the stadium for one of the greatest moments of an outstanding event.

Creepy robot baby now creepier with torso and floppy arms

6 hrs.

A robot baby being built as part of a neuroscience research program in Japan has just gotten a torso, including arms that flop around like an infant?s sans swaddle.

Affeto, the robo-baby, is creepy in its realism, which is what the team from Osaka University aims to accomplish as they use robotics to study ?how humans? higher cognitive functions develop,? according to a project description.

Ultimately, the robot will be used in behavioral experiments. For now, the researchers are trying to ?build a realistic child robot with a muscle-skeletal system.??

The torso?s flexibility comes from 22 pneumatic actuators in its body.

In the video below you can see that Affeto?s torso is approaching the realistic stage. At one point, it hits itself in the face with ?babyish looseness,? Endgadget notes.?

The robot?s face has the thousand-mile stare of a well satiated or exhausted infant, but that may be because the team has yet to pair the torso with the robotic head, which was demonstrated in Feb.?2011.

Stay tuned.

S.Africa's Absa H1 profit down 6 pct on bad debts

JOHANNESBURG (Reuters) - Absa Group, South Africa's third-largest banking group, on Friday reported an expected 6 percent drop in first-half earnings, hit by a spike in bad debts in its home loans business.

The South African lender majority held by Britain's Barclays said headline earnings per share fell to 602.3 cents in the six months to end-June, down from a total 638.5 cents a year earlier.

Headline EPS, which exclude certain one-time items, are the main gauge of profit in South Africa.

Absa, the first of South Africa's big banks to report earnings this season, flagged last month profit would likely fall as much as 10 percent due to sour mortgages.

The warning sent its shares into a tailspin and ignited fears that its recent recovery was losing steam. Absa has in the past few years grown earnings by cutting back bad debts rather than expanding earnings from lending.

Other large South African lenders such as Standard Bank, FirstRand and Nedbank are unlikely to post profit declines as they have set aside adequate provisions, analysts say.

Absa said net interest income, a measure of earnings from lending, totaled 11.9 billion rand, compared with 11.6 billion rand last year.

Credit impairment charges, or bad debts costs, totaled 4 billion rand, an increase of 40 percent from a year earlier.

Lenders in Africa's largest economy have been ramping up unsecured lending to counter slow growth in home and vehicle financing.

Absa has been losing market share to competitors such as FirstRand, and investors are also worried about the exit of several top ranking executives including the deputy CEO Louis von Zeuner.

Absa is the worst performing share among South Africa's big banks this year. Its shares are down nearly 4 percent while bigger rival FirstRand is up 29 percent. Industry leader Standard Bank has gained 13 percent, while Nedbank, South Africa's No.4 bank, has added 19 percent.

Radical Muslims abandon protest outside Olympic Park

LONDON (Reuters) - A group of British Islamists called off a protest planned for outside the London Olympic Park on Friday and organisers said police had told them not to go ahead.

The group, led by some of Britain's most prominent Islamist figures, had intended to gather outside the gates to the park ahead of the opening ceremony to denounce what they called the evil of the Games.

Police said that as it was a standing protest, not a march, the group was not required to obtain permission, but organiser Mizanur Rahman said police had made it clear to him that the protest should not go ahead.

"We would have been immediately arrested otherwise," said Rahman, who served a four-year jail term for encouraging followers to kill British and American troops in Afghanistan and Iraq during a demonstration in London in 2006.

"There's no way for Muslims to voice any of their concerns," said Rahman, whose Website, evilolympics.com, has the tagline "While the world plays, Muslims are being killed around the globe".

He vowed there would be more efforts to protest during the course of the Games.

East London, where the Olympic Park is located, is home to a large Muslim community housed in some of the capital's poorest neighbourhoods. It is also home to a number of British Muslims convicted of involvement in plots since the September 11, 2001, attacks on the United States.

Rahman said the decision of judo chiefs not to allow a Saudi athlete to compete wearing an Islamic headscarf showed why Muslims should boycott the Olympics, which this year coincides with the Islamic holy month of Ramadan.

"I would hope that this would be a sign they should not be in the Games," said Rahman.

90% Bernie

Richard Linklater's "Bernie" is very enjoyable, and it's funny in a dark, unique way. Jack Black gives a wonderful performance as the title character, a mortician and funeral director who appears to have no gender and no sexuality. But ultimately the film doesn't have much to say. It's a good time, and it's worth seeing. But don't expect too much. The film is set in east Texas and is based on actual events. A very unique funeral director becomes the most beloved person in his town, surprisingly enough. When he commits a shocking murder, the town rallies around him, calling to mind "Dog Day Afternoon." The best thing by far, however, are the interviews with actual east Texans who knew the real Bernie. Somehow Linklater is able to get these people to express themselves on camera, using their wildly colorful local slang, and I howled out loud many times. But it's not a very strong statement about the film that the interviews are the best part.

After I finished college, I went to teach first grade at a charter school in Crown Heights, Brooklyn, so I have complicated, conflicted views on education reform that are at once?personal and political.?Nothing bothers me so much as attempts to reduce these serious policy debates to a fight over pejorative rhetorical categories. As I?ve written before, this is a recipe for a pathetic, embarrassing stasis that serves none of the relevant stakeholders.

But here?s Elizabeth Stokes, at the Roosevelt Institute?s Next New Deal, making precisely just that sort of argument:

Market-based school reform is focused on the idea that by structuring schools like business enterprises, we can inject them with stereotypical private sector virtues like innovation and efficiency. According to this view, this is sorely needed because ?traditional? public schools are supposedly ineffective. By removing barriers to entry for different types of educational organizations, market-based reformers believe we can incorporate some healthy competition into the state-run system and overcome drawbacks allegedly caused by the state?s monopoly control. This approach positions parents and students as consumers of education, free to choose which types of schools best meet their individual needs and preferences. The rhetoric of ?choice? implies that marketization will enhance liberty as well as efficiency.

Stokes goes on to chronicle a number of supposedly ?market-based? education policies that undercut public self-governance:

Efficiency considerations aside, the real problem with championing marketized models in education and other areas is the damage it does to democracy. We should not be upholding a model based on turning citizens into consumers. Democratic citizenship does not simply involve an individual?s choice from a platter of options. Rather, it requires?active participation?in?collective decisionmaking.

To sum up: Stokes claims that the ?market-based? approach to education is antithetical to democratic ideals, especially local, participatory discourse. There are a few problems with her argument.?

One first (and simple) point: the CREDO study that Stokes cites in her article is far, far less conclusive than she?s realized. She snags one stat and moves on:

First, despite the grand intentions behind marketized programs, they do not get better results on average than traditional public schools.?A?study?conducted by the Center for Research on Education Outcomes (CREDO) at Stanford University found that 17 percent of charter schools reported academic gains that were significantly better than traditional public schools, 46 percent showed no difference from public schools, and 37 percent were significantly worse.

Boom! Charter schools are always a bad idea! School choice doesn?t work!

But this casual aside misrepresents the data by treating it only at the level of national aggregation. See, the study also says that charter school performance varies widely by state: ?Differences across states in their charter school policies help to explain part of the observed?differences in student results.? The study doesn?t show that charters ?do not get better results??it shows that badly designed charter school policies don?t work as well as better ones. For example, a later CREDO study found that New York charter schools?were much more successful than traditional public schools. In addition, if you?ve read the original study, you know that it showed that students at traditional public schools outperform their peers at charters only for?their first year. In years two and three, charter students outperform traditional students. Here?s a critical paragraph from page 32 explaining why this is so, and why it?s good news for charter schools? future (emphasis added):

Because the number of students attending charter schools grows each year, the experience of?charter school students reflected in each state?s data is skewed toward first-year charter?students. More than half of the records in this analysis capture the first year of charter school?experience. Given the improvement trends shown in Figure 10, the overall charter school effects?would be expected to improve if the same cohort were followed for additional years.?

In other words, the data on charter schools suggest that students who remain at charter schools over a period of time actually outperform students at traditional public schools. The nationally aggregated averages are distorted by the skewed sample set?something noted by the CREDO researchers. Stokes? one-off reference to the CREDO data is dodgy at best and misleading at worst.

Next: it?s disingenuous to lump all charter schools backers as ?market-based? reformers in Stokes? narrow sense. It?s one thing to push for school choice as part of a cynical attempt to convert public education into ?corporate franchises? and quite another to push for school choice in order to provide dramatically better education for the nation?s underserved students?(By the way, it?s a?huge?failing by the Left that people with the latter goal often find it more congenial to partner with conservatives than progressives.). In other words, if you can?t tell the difference between Scott Walker and?KIPP, you?re ideologically blinded.

It?s simply wrong to charge all charter school supporters with the intention of reducing parents (or students) to market consumers. Many support charters because they offer freedom from the extraordinarily restrictive, unhelpful rules in teacher contracts and district rules. For these parents and teachers, charter school support has nothing to do with educational ?markets??and everything to do with making an immediate difference in students? lives. That was certainly true for me when I taught in Brooklyn, and it?s doubly true?now that I have a child of my own.

The most problematic part of Stokes? argument, however, is the amorphousness of what she?s terming ?market-based? reform. Whatever it is, such a reform project isn?t necessarily pro- or anti-school choice. Sure, in a certain way, school choice establishes a market for parents and students. But it?s?not evident that all of the broader education reform arguments correspond to that distinction?it actually obscures more than it helps. In fact, there are major trends in education policy that suggest that the push for school choice is better understood as a grassroots movement?not a corporate campaign.

Here?s an obvious example: the forces arrayed against charters and school choice almost always oppose so-called ?Parent Trigger? laws. These laws allow a majority of parents to petition for their students? school to be closed when they believe that it is broken beyond repair. They allow parents, in other words, to organize, debate, come together, and actively participate in collective decisionmaking regarding their community schools. Surely that sort of grassroots empowerment would be congenial to the opponents of ?market-based? reform? Well?American Federation of Teachers head Randi Weingarten?loathes ?market-based? reform but still stringently?opposes empowering parents with Parent Trigger laws. Does this make her an occasional ?market-based? reformer??Of course not.

This isn?t a logically determinative line of argument?nor is it meant to be. It?s only intended to illustrate that it?s unhelpful to reduce education policy to ?market-based? reformers vs. the democratic public. It attempts to impose a philosophical?and ideological?fault line on policy debates where it doesn?t exist. Approaching arguments through that lens doesn?t advance them in the least?vilification without precision rarely does. It?s worth noting that Parent Trigger laws are only one example of related education policy arguments that don?t correspond. Here?s another: what?s the ?market-based? approach to employing teachers who sexually abuse their students? Or: what?s the ?market-based? approach to determining the appropriate length of a school day or school year? As is the case in so many of these debates, there is no specifically ?market-based? response, because that?s rarely a motivating policy consideration. It?s a distraction to frame the discussion in that way. The relevant question (obviously): what?s best for the students involved?

In other words, there?s nothing actually inconsistent with Weingarten?s position, if we understand her as an actor motivated by protecting existing teacher privileges. Same goes for Stokes?if she happens to share Weingarten?s views in this particular instance. There?s only a problem if Stokes or Weingarten ask us to oppose grassroots education reform while they extol it. There?s only a problem if they want to indict charter schools as un-democratic while simultaneously opposing parental involvement when it doesn?t suit them.

Here?s the kicker: there?s nothing?actually?or?inherently??market-based? about school choice.?Charter opponents are free to support participatory grassroots education policies when they?d like and oppose them when they?d like?but they?can?t pretend that they present a clean, distinct philosophical alternative to the supposedly ?market-based? reformers with whom they disagree.

Songbirds migrate on strict schedule

ScienceDaily (July 25, 2012) ? A new study by York University researchers finds that songbirds follow a strict annual schedule when migrating to their breeding grounds -- with some birds departing on precisely the same date each year.

The study, published in the journal PLoS ONE, is the first to track the migration routes and timing of individual songbirds over multiple years. Researchers outfitted wood thrushes with tiny geolocator "backpacks," recording data on their movements.

Spring departure dates of birds heading from the tropics to North American breeding grounds were surprisingly consistent, with a mean difference of only three days from year to year, the study reports. Fall migration, however, was far less predictable. Males on average flew faster than females, and first-timers lagged behind those with more than one journey under their wings.

The geolocators, which are smaller than a dime, are mounted on birds' backs with thin straps looped around their legs. The devices measure light, allowing researchers to estimate latitude and longitude by recording sunrise and sunset times.

"It's quite surprising that the schedules of these birds are so consistent across the entire route, with some of them departing the tropics and arriving at breeding sites in North America on the same day in different years," says study author Kevin Fraser, a postdoctoral Fellow in York's Department of Biology, Faculty of Science & Engineering. "Much like airplanes, there are many factors that can influence birds' flight schedules, such as weather at departure and expected conditions at the other end of the journey. Amazingly, these small songbirds are highly consistent in their timing between years."

Interestingly, while their departure times are precise, songbirds' migratory routes can vary widely. "Migratory routes sometimes differed by several hundred kilometres between years, which may reflect a fine-tuning of migration in response to wind and weather conditions en route, such as during large open-water crossings like the Gulf of Mexico," he says.

As for arrival times, birds need to be early to lay their claim to prime breeding grounds -- but not too early.

"There is intense pressure for birds to get back to breeding grounds early to secure good territories, nest sites and, of course, mating opportunities. The early birds tend to do better and raise more young. However, cool weather in early spring can reduce food availability and even survival of early birds," Fraser says. He cautions that songbirds' consistent timing may come at a cost.

"The concern is that birds may not be able to flexibly adjust their schedules to meet new conditions with climate change," says Fraser. "This is a topic we're pursuing in current research."

The birds Fraser tracked were tagged in Pennsylvania and Costa Rica, at field research sites of his supervisor, York University Professor Bridget Stutchbury, who has studied the behavioural ecology of birds for decades. Her 2007 book, Silence of the Songbirds, details the threat to the species posed by climate change and habitat destruction.

"Numbers [of wood thrush] have plummeted in Canada by over fifty percent since the 1960s. When we lose the wood thrush, and other songbirds, we lose an integral part of the forest itself," Stutchbury says.

Lawyers: Audio is Sandusky phoning abuse victim

Gene J. Puskar / AP files

Former Penn State assistant football coach Jerry Sandusky, left, was convicted of child sex abuse crimes in part due to the testimony of a key witness, former assistant coach Mike McQueary, right.

By NBC News staff and wire services

Updated at 2:37 p.m. ET: HARRISBURG, Pa. -- Lawyers for a man who claims to be the unknown victim abused in a Penn State shower by Jerry Sandusky in a case that led to Joe Paterno's firing say he intends to sue the university.

The?lawyers also released two audio clips that they say are phone mail messages from Sandusky to their client, referred to in court documents as Victim 2.

In the messages from September 2011, which can be heard in the links below provided by the lawyers,?Sandusky talks about moving forward and having nothing to hide. In one message, Sandusky offers an invitation to?a Penn State football game. He ends both calls with "love you."

You can hear audio of an alleged message from Sept. 12, 2011, here.

You can hear audio of an alleged message from Sept. 19, 2011, here.

The lawyers, Andrew Shubin, Justine Andronici,?Matt Casey and Joel Feller,?said in a statement that they have done an extensive investigation and gathered "overwhelming evidence" on details of the abuse.

The statement reads in part:

"Our client suffered extensive sexual abuse over many years both before and after the 2001 incident Michael McQueary witnessed in the Penn State Lasch building shower. Penn State has now admitted and there is no longer any question that its top officials could have and should have prevented these acts. Jerry Sandusky's abuse of Victim 2 and other children is a direct result of a conspiracy to conceal Sandusky's conduct and the decisions by top Penn State officials that facilitated and enabled his access to victims. We intend to file a civil lawsuit against Penn State University and others and to hold them accountable for the egregious and reckless conduct that facilitated the horrific abuse our client suffered.

Our client has to live the rest of his life not only dealing with the effects of Sandusky's childhood sexual abuse, but also with the knowledge that many powerful adults, including those at the highest levels of Penn State, put their own interests and the interests of a child predator above their legal obligations to protect him."

Penn State says it cannot comment on pending litigation.

Prosecutors have said they don't know the identity of the boy molested by Sandusky in 2001. The encounter was spotted by former graduate assistant football coach, Mike McQueary, who reported the abuse to school officials, including Paterno, but none of them told police. McQueary said he saw Sandusky and the boy -- now a grown man -- in an "extremely sexual" position in a locker room shower one night. He was a key prosecution witness at Sandusky's trial.

The victim is not named in the attorneys' statement.

Sandusky awaits sentencing after being convicted in June of 45 sex abuse counts related to molesting 10 boys, including Victim 2.

The jury in the Jerry Sandusky sexual abuse trial found him guilty on 45 of 48 counts. NBC's John Yang and Michael Isikoff report.

A seven-month investigation by former FBI Director Louis Freeh, commissioned by Penn State, concluded that Paterno, then-university President Graham Spanier and two other top Penn State administrators?concealed abuse by Sandusky to avoid bad publicity, thereby enabling Sandusky's crimes to continue.

Below is a transcription of the phone mail messages:

?Sept. 12, 2011:

"?Jere. Um. I am probably not going to be able to get a hold of anybody. Um. Uh. Probably ought to just go forward. Uh. I would be very firm and express my feelings, uh, upfront. Um. But, uh, you know, there is nothing really to hide so. Um. If you want, give me a call. You can call me on my other cell phone or on this one, either one so. Alright, take care. Love you. Uh. Hope you get this message. Thanks."

?Sept. 19, 2011:

"?Just calling to see you know whether you had any interest in going to the Penn State game this Saturday. Uh. If you could get back to me and let me know, uh, I would appreciate it and when you get this message, uh, give me a call and I hope to talk to you later. Thanks. I love you.?

Tourist to pay $6,500 fine for '98 Cuba trip

A New York man agreed Tuesday to pay a $6,500 fine to settle a long-running dispute with the U.S. Treasury Department over a trip he made to Cuba as an unauthorized tourist 14 years ago.

Zachary Sanders, now 38, said he was 23 and had been living and teaching English in Mexico when he decided to go to Cuba for a couple of weeks in 1998.

"I wanted to learn about how a socialist country worked in practice," Sanders said in an interview. "I had no illusions. ... I'm not like some diehard supporter of the (Cuban) government or anything like that."

Varying enforcement of restrictions
The United States has long restricted U.S. travel to Cuba as part of a 50-year-old trade embargo aimed at punishing Cuba's communist government. The actual restrictions and the degree of enforcement have varied with different U.S. administrations and with the evolving state of U.S.-Cuba relations.

Sanders did not obtain the required U.S. Treasury license to visit Cuba and a U.S. Customs agent became suspicious when Sanders returned to the United States through the Bahamas without declaring that he had been to Cuba. The agent also seized an undeclared box of Cuban cigars from Sanders' luggage.

Two years later, Sanders received a letter from the Treasury Department asking for details of his expenditures in Cuba. He said he was scared, had lost the receipts and missed the deadline to return the form.

Another two years went by and the department's Office of Foreign Assets Control (OFAC) reviewed his case during a Bush administration crackdown on travel to Cuba, notifying Sanders of its intent to fine him for failing to return the form. In 2008, an administrative law judge fined him $1,000.

Both sides appealed, and on the final business day of the Bush administration in January 2009, a Treasury administrator raised the fine to $9,000. He reasoned that the original fine was too low to discourage people from ignoring OFAC forms.

Sanders had a constitutional right not to provide incriminating evidence against himself, said his lawyer, Shane Kadidal of the Center for Constitutional Rights.

Now a lawyer representing immigrants
By the time the fine was issued, Sanders had successfully battled cancer, completed law school and been admitted to law practice in New York, where he is a sole practitioner who mainly represents poor immigrants.

He also passed the bar exam in New Jersey, but was denied admission to that state's bar because he acknowledged that he had gone to Cuba knowing it was illegal.

Sanders sued OFAC, the Treasury Department and the Justice Department in federal court in 2009, appealing the fine as arbitrary and capricious. He lost and then turned to the U.S. Court of Appeals in New York, where Tuesday's settlement agreement was filed.

Full international coverage from NBCNews.com

'An ideological traveler'
Kadidal said Sanders' fine was still far greater than most Americans pay for violating the travel ban, and suggested he had been singled out because he was "an ideological traveler."

Civil penalties for tourist travel to Cuba can range up to $7,500 for the first trip and $10,000 for subsequent trips.

OFAC resolved more than 200 such cases for "a standard $1,000 settlement" from 2001 to 2004, Kadidal said, and dismissed many others with no fine at all.

Under the Obama administration, which has relaxed restrictions on travel to Cuba, OFAC has generally pursued cases against financial institutions and manufacturers that violate the embargo, rather than individual travelers.

The case is Sanders vs. Szuben, Case No. 12-601 cv in the U.S. Court of Appeals for the Second Circuit.

Altan-Bonnet is the second Rutgers-Newark professor to receive the Presidential Early Career Award for Scientists and Engineers in 2 years

Fewer than 100 researchers nationwide are chosen each year to receive the Presidential Early Career Award for Scientists and Engineers (PECASE), and this year Dr. Nihal Altan-Bonnet is one of the 96 to receive this honor.

"Dr. Nihal Altan-Bonnet is a superb cell biologist in the Department of Biological Sciences at Rutgers University, Newark, pursuing in her research an understanding of viral replication in infected cells," noted Interim Chancellor Philip Yeagle. "That her outstanding research has now attracted one of the highest honors a young scientist in this country can receive gives us here at Rutgers great joy and pride. She is the second member of our faculty to have received this rare honor in the past two years, which speaks to the extraordinary quality of our faculty on the Newark campus of Rutgers University."

Altan-Bonnet, a member of the Rutgers-Newark faculty since 2006, is one of two New Jersey researchers, one from Rutgers and one from Princeton, receiving this year's PECASE award. She has been cited for "research identifying a common lipid blueprint for viral replication and potential panviral therapeutics." She will join the other honorees for a White House ceremony with President Barack Obama this fall.

Nihal Altan-Bonnet, a resident of New York City, received her bachelor of science degree from Hunter College and her doctoral degree in cell biology from The Rockefeller University, both in New York City. Her research has been widely published in academic journals, most recently in Cell, Trends in Biochemical Sciences, Journal of Virology, Proceedings of the National Academy of Sciences, Journal of Cell Science, Nature Cell Biology and Molecular Biology of the Cell.

"The viral repertoire on our planet is dominated by RNA (ribonucleic acid) viruses," explains Altan-Bonnet. "Many of them are pathogenic and cause human diseases with major health and socioeconomic consequences such as poliomyelitis, influenza, hepatitis, SARS, AIDS, Ebola and the common cold." (An RNA virus is a virus that has RNA, rather than DNA, as its genetic material.) "Individuals can often be infected with multiple different viruses at a given time. Hence, development of panviral therapeutics is an urgent need in combating these types of multiple viral infections."

Many of the pathogenic RNA viruses use their host cells' intracellular membranes as a platform on which to replicate themselves. With grants from the National Institutes of Health, Altan-Bonnet and her "Host-Pathogen Dynamics" lab group have been studying the molecular nature of these platforms. They have found that viruses, before they start replication, remodel the membranes into their "perfect replication" platform.

Altan-Bonnet has discovered that there is a common membrane blueprint for the perfect replication platform, shared by multiple different viruses including ones that cause the common cold, poliomyelitis and hepatitis C.

Altan-Bonnet and her colleagues have identified critical lipid molecules present within these platforms that viruses rely upon for replication. Having identified these molecules and where they are derived from in the host cell, Altan-Bonnet is now working with industry partners to design and test therapeutics targeting their virus production, that will address panviral effectiveness.

About PECASE

PECASE awardees are selected for their pursuit of innovative research at the frontiers of science and technology, and their commitment to community service as demonstrated through scientific leadership, public education, or community outreach. Winning scientists and engineers receive research grants for up to five years to further their studies in support of critical government missions.

In a statement announcing the awards, President Obama said, "Discoveries in science and technology not only strengthen our economy, they inspire us as a people. The impressive accomplishment s of today's awardees so early in their careers promise even greater advances in the years ahead."

Ten federal departments and agencies join together annually to nominate scientists and engineers whose early accomplishments show the greatest promise for assuring America's preeminence in science and engineering and contributing to the awarding agencies' missions. Altan-Bonnet was nominated by the National Institutes of Health, Department of Health and Human Services.

The awards, established by President Clinton in 1996, are coordinated by the Office of Science and Technology Policy within the Executive Office of the President.
